Legal use

You may only use pocketchat within the scope of this agreement and only for test purposes.BionLyx must only be used within the scope of legal regulations that are applicable to you and you must not violate any rights of third parties. Under no circumstances may BionLyx be used for the preparation and execution of criminal offences such as copyright infringements.

Export control

BionLyx may only be used in the European Union. It is prohibited to use BionLyx in a country if this violates the applicable export regulation. By applicable export regulations we mean the common foreign and security policy regulations of the European Union.

Information on data protection in the mobile app

§ 1 Information on the collection of personal data

(1) In addition to our online offer, we provide you with a mobile app that you can download to your [mobile device]. In the following, we inform you about the collection of personal data when using our mobile app. Personal data is all data that can be related to you personally, e.g. name, address, e-mail addresses, user behaviour.

(3) When you contact us by e-mail or via a contact form, your e-mail address and, if you provide it, your name and telephone number will be stored by us in order to answer your questions. We delete the data accruing in this context after the storage is no longer necessary or - in the case of legal retention obligations - restrict the processing.

(4) If we use commissioned service providers for individual functions of our offer or would like to use your data for advertising purposes, we will inform you in detail about the respective processes below. In doing so, we will also state the specified criteria for the storage period.

§ 2 Your rights

(1) You have the following rights vis-à-vis us with regard to the personal data concerning you:

  • Right to correction or deletion,
  • Right to restriction of processing,
  • Right to object to processing,
  • Right to data portability.

(2) You also have the right to complain to a data protection supervisory authority about the processing of your personal data in our company.

§ 3 Collection of personal data when using our mobile app

(1) When you download the mobile app, the required information is transferred to the App Store, i.e. in particular user name, e-mail address and customer number of your account, time of download, payment information and the individual device identification number. We have no influence on this data collection and are not responsible for it. We only process the data insofar as it is necessary for downloading the mobile app to your mobile device.

(2) When using the mobile app, we collect the personal data described below in order to enable the convenient use of the functions. If you want to use our mobile app, we collect the following data, which is technically necessary for us to offer you the functions of our mobile app and to ensure stability and security (legal basis is Art. 6 para. 1 p. 1 lit. f DS-GVO):

  • IP address
  • Date and time of the request
  • Time zone difference to Greenwich Mean Time (GMT)
  • Content of the request (specific page)
  • Access status/HTTP status code
  • Amount of data transferred in each case
  • Website from which the request came

(3) Furthermore, we need [your device identification, unique number of the end device (IMEI = International Mobile Equipment Identity), unique number of the network subscriber (IMSI = International Mobile Subscriber Identity), mobile phone number (MSISDN), MAC address for WLAN use, name of your mobile end device, e-mail address].

(4) The mobile app does not use cookies.

(5) For advertising purposes, we use the so-called "Advertising Identifier" (IDFA). This is a unique, but non-personalised and non-permanent identification number for a specific end device, which is provided by iOS. The data collected via the IDFA is not linked to any other device-related information. We use the IDFA to provide you with personalised advertising and to analyse your usage. If you activate the option "no ad tracking" in the iOS settings under "Privacy" - "Advertising", we can only take the following measures: Measuring your interaction with banners by counting the number of times a banner is displayed without being clicked ("frequency capping"), click-through rate, unique user detection, security measures, fraud prevention and troubleshooting. You can delete the IDFA in the device settings at any time ("Reset Ad ID"), in which case a new IDFA will be created which will not be merged with the previously collected data. We would like to point out that you may not be able to use all the functions of our app if you restrict the use of the IDFA.

§ 4 Use of your address book, calendar, photos and memories

(1) When you start using our mobile app, we will ask you for permission to use your address book, calendar, photos and reminders in a pop-up. If you do not give us permission, we will not use this information. You may not be able to use all the features of our app. You can give or revoke permission later in the app settings.

(2) If you allow access to this data, the mobile app will only access your data and transfer it to our server to the extent necessary to provide the functionality. Your data will be treated confidentially by us and deleted if you revoke the rights to use it or if it is no longer necessary for the provision of the services and there are no legal retention obligations. The legal basis for the processing is Art. 6 (1) sentence 1 lit. f DS-GVO.

§ 5 Collection of your location data

(1) Our offer includes so-called location-based services, with which we offer you special offers that are tailored to your respective location. You can only use these functions after you have agreed via a pop-up that we can collect your location data by means of GPS and your IP address in anonymised form for the purpose of providing the service. You can allow or revoke this function at any time in the settings of the app or your operating system by going to "Settings/Location". Your location will only be transmitted to us if you use functions in the app that we can only offer you if we know your location.
